Dear surfers!
Please read the terms of use of the site and the privacy statement, which constitute an agreement between us and you, carefully before browsing the site or using any of its services. The terms of use and the privacy statement will be referred to hereinafter – “terms of use“.
Important to know!
The use of the site’s services or part of them (including browsing, registration for the customer club, registration to receive promotional material and purchasing tickets through the site) will constitute your agreement to the terms of use.
If you do not agree to the provisions of the terms of use or part of them, do not browse the site and do not use its services in any other way.
Violation of the terms of use and/or violation of any obligation of the surfer from those listed in the terms of use may result in blocking access to the site, in addition to any other right available to Kikar Hamusica under any law.
The above is an integral part of the terms of use.

Introduction

Kikar Hamusica Ltd. Company No. 514800804 (hereinafter – “Kikar Hamusica”), develops and operates the site. The site is located and operates under a domain name owned by Kikar Hamusica at https://kikar-hamusica.com, or any sub-domain name (sub-domain) (hereinafter: “the site”). In addition, Kikar Hamusica operates content environments within other platforms, such as: Facebook, Instagram and YouTube (hereinafter: “content environments”), and everything stated in these terms of use will apply equally to the use of these content environments and to any content displayed in them.
What is written above and below applies to every male and female surfer on the site, and the use of the masculine language is for convenience only.
The chapter headings of the terms of use are for convenience only, and should not be considered binding or assisting in interpretation.
These terms of use apply to any use made of the site, whether via the Internet or in any other way. Likewise, the terms of use apply to the use of the site in any form via computers or any other device, including cell phones, handheld computers, etc.
These terms of use apply to all content displayed on the site, even if displayed via a deep link from another domain.
Kikar Hamusica reserves the right to amend, remove or add conditions to the terms of use and to block or restrict access to the site, at any time. You must check the site from time to time, the legal notices appearing on it and the other additional conditions, as they are binding on you. In the event of a change in the terms of use, we will update you on the home page of the site via a “pop-up” window in which you will be offered the option to approve the updated terms of use, and continued use of the site after the change indicates your agreement to the new conditions. If you do not agree with the new conditions, you must stop any further use of the site and contact us with a request to delete the information.
Kikar Hamusica will be entitled to determine that the use of the services on the site or part of them is subject to payment, as indicated on the site near each paid service. Different conditions relating to payment, which may appear near the service as mentioned, also constitute an integral part of these terms of use.
In addition to the definitions appearing anywhere else in the terms of use, the following definitions will apply:
1. “Surfer”/”Surfers”: any person browsing the site, paid or unpaid, with or without the consent of the person responsible for the surfer.
2. “The responsible”: the parents or guardian of a minor or legally incompetent surfer.
3. “Content” or “Contents”: any information of any kind, including any message, verbal, visual, audio, audiovisual content, as well as any combination thereof, as well as their design, processing, editing, distribution and display method, including (but not limited to): any image, photograph, illustration, animation, diagram, figure, simulation, sample, video, audio file and music file, software, file, computer code, application, format, protocol, database and interface as well as any character, sign, symbol and icon.

General Terms and Rights in Content

Unless expressly stated otherwise, all copyrights and all other intellectual property rights in all materials, contents and information on the site (including, among others, the site name, photographs, illustrations, icons, etc.) are the exclusive property of Kikar Hamusica or those who granted it a license to use these materials. Granting access or use of the site does not grant or transfer to the user or any third party any ownership right, use, intellectual property right or other rights; it is hereby clarified that all rights and ownership of this site, its materials and contents, in all the different aspects related to the site, are the exclusive property of Kikar Hamusica and/or on its behalf. The site is protected under copyright laws and under any law. In the event that you violate the provisions of these terms of use or the conditions appearing on the site, the permission given to you to use the site will expire immediately. All rights reserved to Kikar Hamusica.
Kikar Hamusica and/or the entities related to it, as the case may be, will be entitled to use the software, content and information as mentioned according to their sole and free discretion, anywhere and in any way, without any limitation, without the need to obtain any approval or pay any compensation, including selling, transferring, copying, modifying, using, displaying and publicly performing and granting sub-licenses in the aforementioned content or part thereof, subject to the provisions of any law.
The surfer waives all his rights in any content uploaded to the site by him, including copyrights (including moral rights) and all rights in these contents will belong to Kikar Hamusica only.
By sending, placing or transferring material, content or information (“material”) by you to this site, the surfer declares and confirms that this material is not confidential, is not subject to ownership rights or copyrights and does not violate any legal provision. Without detracting from the generality of the foregoing, it is strictly prohibited to upload materials that contain threats, libel, slander, obscene, pornographic, crude or vulgar content, or uploading any material that may constitute a criminal offense or encourage behavior that may constitute a criminal offense or violate intellectual property laws, privacy protection laws, defamation laws and any other law.
Kikar Hamusica is not responsible for contents entered and/or uploaded to the site by third parties and it will not be able to prevent the existence of offensive material on the site.
Without detracting from what is stated in section 13 above, Kikar Hamusica will be entitled, at any time and according to its sole discretion, whether or not it received a demand for it, to remove and/or delete and/or change any content, information or link uploaded by a surfer and/or refuse to enter or load it on the site without having to justify this decision. Without detracting from the foregoing, Kikar Hamusica will be entitled to cancel a user’s registration to the site and/or block his access to the site and/or prevent a certain user from publishing additional contents on the site, according to its sole discretion.
Without detracting from what is stated in sections 13-14 above – a surfer who found that content and/or information and/or a link uploaded to the site violates his rights, will notify Kikar Hamusica of the violation by contacting contact@hebrewmusicmuseum.com. The surfer’s notification will include accurate details about the surfer – full name, postal address, email address and phone number, in a way that allows identification and contact with him.
Kikar Hamusica will be entitled, according to its sole discretion at any time and without prior notice, to adapt and/or suspend and/or stop and/or change and/or limit the site’s services, the information appearing on it, the site’s contents – all or part of them – including access permissions, availability of activities and services, various contents, operating hours, content, as well as software and/or equipment required to access the site and its services. Kikar Hamusica reserves its right to limit certain activities and/or access to the site’s services in whole or in part, with respect to a certain surfer or in general. In any case, Kikar Hamusica will not be liable for any damages resulting from the foregoing, even if it foresaw or could have foreseen these damages.
Kikar Hamusica may change and/or correct and/or remove and/or add conditions to the terms of use or part of them at any time, according to its sole discretion as detailed above. The changed and/or corrected terms of use will be published on the site and will be binding from the moment of their publication.
Kikar Hamusica may offer, according to its sole discretion, special activities and contents subject to special or different conditions that will be brought to the attention of the surfers or part of them. It is hereby clarified that participation in the activities and/or exposure to the aforementioned special contents will be considered as agreement to the special conditions, which will be detailed as much as possible near each such special activity.

Surfers’ Declarations and Obligations

The surfer on the site declares and undertakes as follows:
1. He is over 18 years old and authorized to enter into this agreement, and if he is under 18 years old or legally incompetent, his entering into this agreement is done with the consent of the responsible, and if he is a corporation, it is legally incorporated. In the case where a minor provided us with information about himself, the minor’s parent or guardian must contact us and request the deletion of the information from our records.
2. He and all users on his behalf will fully comply with these terms of use and/or any legal provision and/or Kikar Hamusica’s instructions, within the framework of their use of the site, and the surfer will be responsible for the use made of the site by any user on his behalf.
3. All information he provides to Kikar Hamusica or any other entity for the purpose of registration and/or purchase and/or as required anywhere on the site, including credit card details, and all information he publishes and uploads will be true, accurate, consistent with reality and not misleading.
4. That he will be responsible for any damage caused to the surfer and/or any third party as a result of reliance on the contents displayed on the site and/or through it, and that he is aware that Kikar Hamusica will not be liable for any direct and/or indirect, financial or other damage caused to surfers and/or third parties as a result of using the site and/or relying on the content appearing on it. What is stated in this section will apply even if Kikar Hamusica and/or on its behalf foresaw or could have foreseen the damage in advance.
5. That he is aware that the personal details he provides, if provided, will be stored in a database, as detailed in the privacy policy below and subject to the provisions of any law.
6. That he is aware that Kikar Hamusica does not provide any equipment and/or infrastructure necessary to access the Internet and to receive the site’s services, including telephony equipment, modems and Internet access software.
7. Not to copy and/or “download” and/or distribute and/or sell and/or trade and/or change and/or process and/or display publicly and/or use the site and/or its content in whole or in part, unless he received the express prior written approval of Kikar Hamusica. The surfer declares that he is aware that Kikar Hamusica may be required to pay third parties due to his violation of this section, and he undertakes to indemnify and/or compensate it without delay for any amount that Kikar Hamusica will be required to pay to a third party as mentioned, including legal expenses and actual attorney fees incurred by Kikar Hamusica as a result. In addition, the surfer agrees in advance that in the event of violation of this section by him, Kikar Hamusica will be entitled to obtain identifying details about him from any Internet provider and from any other entity.
8. Without detracting from what is stated in section 19.7, any “download” and/or copy and/or any other use, if approved by Kikar Hamusica, will be done with a mention that it was done with the approval of Kikar Hamusica and that all rights are reserved to Kikar Hamusica.
9. Not to use the site’s services and/or the content appearing on it outside the framework of the site and/or according to these terms of use and/or according to law and not to use the site’s services for profit or commercial purposes.
10. To compensate and/or indemnify immediately upon first demand Kikar Hamusica and/or any entity whose contents are included in the site as well as any license holder and/or other rights holder in the site for any damage caused to them due to violation of the terms of use. In the event that a legal claim and/or any other proceeding is filed against Kikar Hamusica in connection with the violation of the terms of use by a surfer, Kikar Hamusica reserves its right to manage the defense itself in the proceedings initiated against it, and the surfer undertakes to cooperate with Kikar Hamusica in any such legal proceeding.

Customer Club and Receiving Promotional Material

Any surfer over the age of 18 (including companies and corporations) will be entitled to register for the customer club and receive promotional material (mailing) from Kikar Hamusica – mailing that will be sent from time to time by Kikar Hamusica and will include information, updates and various advertisements regarding Kikar Hamusica’s events, shows and special projects (hereinafter: “the service”). Joining the service is free.
A surfer joining the service accepts all these terms of use and undertakes to act in accordance with them.
By registering for the service from Kikar Hamusica’s site, the surfer gives his consent to these terms of use, including the use of his details and their inclusion in a database as detailed in this document.
By joining the mailing service from Kikar Hamusica’s site, the user agrees that Kikar Hamusica will be entitled, subject to any law, to transfer his details to other entities for the purpose of adapting and improving the service conditions, provided that the third party to which the details will be transferred will not use them beyond what is permitted to it by law, will keep them confidential and will not transfer them to any other entity without Kikar Hamusica’s consent and that the users’ privacy will not be harmed. The user agrees to the aforementioned use of the information and confirms that this use will not be considered an infringement of the user’s privacy and will not entitle him to any remedy and/or compensation. The user may revoke this consent by giving written notice to the address contact@hebrewmusicmuseum.com. In the event of revocation of the user’s consent as mentioned here, Kikar Hamusica will be entitled, according to its discretion, to cancel the registration for the service.
Any user of the service will be entitled to cancel his registration for the service at any time, by clicking on the “removal” link appearing in each of the mailings sent by Kikar Hamusica.
Kikar Hamusica will be entitled not to approve a person’s joining the mailing service, according to its discretion and without having to justify its refusal.
The user of the service will be responsible for reporting to Kikar Hamusica any changes in his personal details, in order to enable continuous and proper contact with him. Kikar Hamusica will not be responsible for not receiving the service due to failure to update the user’s personal details.
Kikar Hamusica will be entitled to decide at any time to stop the service.

Use of Messaging Services

The site contains or may contain in the future forums, blogs, chats, communities, etc. (all the aforementioned services hereinafter: “messaging services”). The messaging services are public communication, so any content published or uploaded within these services by any surfer is exposed and visible to others. Therefore, in any use of the messaging services, caution should be exercised in publishing personal data, identifying details of the surfer himself or anyone related to him or any other sensitive detail.
The use of the messaging services will be done only for sending and receiving messages and information suitable for each service. Within the framework of using the messaging services, the following actions must not be performed:
1. Violation of any law or agreement, including these terms of use.
2. Threat, insult, intimidation, harassment, defamation of any other person, including any corporation.
3. Publication and/or distribution and/or uploading files (upload) of any information, content, details or any other material of any kind, which constitutes a violation of any law and/or infringement of any third party, including, but not limited to: violation of criminal law, violation of any intellectual property rights, infringement of privacy and/or good name, defamation, profanity, abomination, incitement and pornographic contents.
4. Distribution and/or publication and/or uploading files containing computer viruses of any kind, “Trojan horse”, “worm” and/or any other file that may cause damage and/or harm and/or transfer any information in the possession of a third party without the knowledge and consent of that third party or that may harm a third party or its property.
5. Conducting surveys, polls, contests, chain letters and “pyramid games”.
6. Any publication and/or information and/or offer of a commercial nature.
7. Any restriction, interference or prevention of the use and enjoyment of the messaging services and/or the site by other surfers.
Kikar Hamusica will be entitled, but not obliged, to monitor the activity of the messaging services, and in particular will be entitled to examine and/or approve and/or remove and/or delete and/or edit any content appearing in the messaging services, all or part of them, according to its sole discretion. To remove doubt, it is clarified that the foregoing does not constitute an obligation on the part of Kikar Hamusica to perform the foregoing, and does not impose any responsibility on Kikar Hamusica nor detract from the surfer’s responsibility.
Kikar Hamusica provides the platform for the messaging services, but is not responsible for the content published in them by the surfers. Therefore, Kikar Hamusica will not bear any responsibility for publishing any contents within the framework of the messaging services and/or in connection with damages caused as a result of publishing the contents as mentioned.

Purchasing Tickets via the Site

The site offers the possibility of online purchase of tickets for shows and/or events at Kikar Hamusica. It is clarified that the sale of the products is done by Kikar Hamusica, through the credit card clearing company “Pelecard” (“credit card clearing company”) and that it bears responsibility for everything related to clearing, billing, shipping and everything related to it). A surfer who chooses to make an online ticket purchase will be subject, in addition to these terms of use, to the regulations of the credit card clearing company and will be asked to approve his consent to the regulations of the credit card clearing company when making the purchase.
The site will allow ticket purchases by the surfer, provided he is 18 years old. These purchases will require providing details as required to make the purchase. To remove doubt, all the details that the surfer will be required to provide when ordering the ticket will reach the credit card clearing company, and Kikar Hamusica bears no responsibility for the use that will be made of this data by the credit card clearing company. The surfer is aware and agrees that Kikar Hamusica’s privacy statement published on the site does not apply to the credit card clearing company and it is possible that the credit card clearing company will use the details transferred to it, not in accordance with Kikar Hamusica’s privacy statement.
The surfer undertakes to provide, when ordering the ticket, all the required details in a complete and accurate manner. Without detracting from any other remedy available to Kikar Hamusica under this agreement or under any law due to providing inaccurate and/or incomplete details, if the surfer provided incomplete and/or inaccurate details, Kikar Hamusica will not be responsible for any malfunction in ordering the tickets and/or delivering them to the surfer.
The purchased tickets are non-cancellable or exchangeable, and no credit or refund is possible against them. In the event of loss or theft, Kikar Hamusica will not be obliged to issue a replacement ticket, and issuing a replacement ticket will be done in exceptional cases only, and according to the sole discretion of Kikar Hamusica.
In the event of cancellation of a purchase by the surfer, Kikar Hamusica will not be obliged to refund any amount collected by it, and refund of money will be done in exceptional cases only, and according to the sole discretion of Kikar Hamusica.

Kikar Hamusica’s Policy Regarding Event Contents and Dates, Ticket Collection and Entry to Events

The reserved seats will not be kept for the orderer after the start of the event.
Entry to the event will not be allowed after 20 minutes after the start of the event. Despite what is stated in this section, the event manager will be entitled to decide in certain cases according to his sole discretion that entry to the event will not be allowed even immediately after the start of the event and in certain other cases, to allow entry to the event even after 20 minutes from the start of the event.
Kikar Hamusica reserves the right to make changes of any kind at any time in its programs (including content, date, time, location, length of performance, artists and/or actors appearing, etc.) without prior notice to the surfer and without the surfer being entitled to compensation or any remedy, except for refund of the payment for the tickets if one or more of the following conditions are met:
1. The date of the event changed or the event was canceled.
2. The start time of the event changed by a period exceeding 30 minutes.
3. A central figure among the event participants was replaced.
In addition to what is stated in this agreement, the conditions detailed on the site regarding the specific event will apply to ticket purchases.
Kikar Hamusica reserves the right to decide when and in what way and/or means (telephone sale only, sale on the site only, sale at the physical box offices in the Kikar Hamusica complex only), or a combination thereof, the tickets for a certain event will be sold.

Limitation of Liability

The site’s services are provided as is (AS IS). Kikar Hamusica does not guarantee and will not be responsible to the site’s surfers regarding the quality of the services and/or the content on the site and/or the availability of the services on it. To remove doubt, it is declared that Kikar Hamusica takes steps to secure the site and preserve the privacy of surfers, in accordance with the site’s privacy statement as it will be published on the site from time to time, but will not be responsible for any breach, malfunction or other security defect, whatever its cause, and the use of the site and its services is done under the sole responsibility of the surfers.
The surfer is aware that some of the services on the site will be provided by other entities on behalf of Kikar Hamusica. If this is indicated on the site, Kikar Hamusica will not bear any responsibility for the activity of those other entities.
Without detracting from what is stated in these terms of use, Kikar Hamusica will not be liable in relation to contents that will be published on the site and/or in relation to services and/or products and/or deals offered by third parties including advertisement content, coupons and any commercial information appearing on the site, if and to the extent they appear, or for any result and/or damage due to their publication and/or reliance on them and/or use of them. Anyone who deals with any entity following publications made on the site does so under his sole responsibility, and Kikar Hamusica will not bear any responsibility in this regard, even if it knew or should have known of foreseeable damage and/or results as mentioned.
Publication of advertisements and/or coupons and/or promotions on the site does not constitute a recommendation or encouragement on the part of Kikar Hamusica to purchase the services and/or products offered in them, and the conditions of any transaction that will be made following an advertisement, coupon, promotion or any other information published on the site will be agreed directly between the surfers and the advertiser and/or the relevant supplier and under their sole responsibility. It is clarified that Kikar Hamusica did not check the contents published by third parties on the site, and is not responsible for what is stated in them. To remove doubt, Kikar Hamusica is not and will not be a party to any such transaction. The surfers and subscribers hereby waive in a complete and irrevocable manner any claim and/or demand against Kikar Hamusica in relation to the aforementioned information, publications and contents.
The site may contain links to other sites, Israeli or foreign (hereinafter – “other sites”). Kikar Hamusica is not responsible for these sites, their contents or the services offered on them. Kikar Hamusica is not responsible for services on other sites and/or for any damage caused by them, including harm to the surfer’s feelings. Kikar Hamusica is not responsible for services and/or products purchased and/or that can be purchased on other sites and/or for information security and/or the way the surfer’s details are used on other sites. The presence of links to other sites on Kikar Hamusica’s site does not constitute a recommendation to visit any of them, unless expressly stated. Kikar Hamusica declares that no steps were taken on its part to check the accuracy or reliability of the contents included in the aforementioned other sites, or the services and/or products offered through such sites, or their suitability for certain surfers. Kikar Hamusica recommends carefully checking any other site before browsing it and/or taking part in the activities offered on it, and in any case – anyone entering another site via a link from the site does so under his sole responsibility.
Kikar Hamusica will not bear any responsibility for interruptions, malfunctions, response times, viruses or any other factor that may interfere with or damage the site’s services and/or cause any damages to the site’s users.
Kikar Hamusica will not bear any responsibility for damages caused to the surfer’s and/or subscriber’s computer system and/or infrastructure, loss of information, or any other damage resulting from the use of the site, including downloading information and/or software through the site’s services.

Violation of this Agreement

Without detracting from any other remedy available to Kikar Hamusica under this agreement and/or under any law, Kikar Hamusica will be entitled to take any action to prevent violation of the agreement and/or repeated violation of the agreement, including blocking and/or disconnecting a user and/or limiting access to the site and/or any other action that will enable preventing violation of the agreement and/or reducing damage caused by a violation already committed.
In the event of violation of this agreement, the surfer waives his rights under the Privacy Protection Law and/or under any applicable law whose purpose is to protect his privacy and agrees in advance that Kikar Hamusica will be entitled to obtain identifying details about him from any entity, including Internet providers.
The surfer will compensate and/or indemnify Kikar Hamusica and/or on its behalf for any damage caused to them due to violation of the terms of use.

Miscellaneous

Kikar Hamusica alone will be entitled to assign, transfer or pledge its rights (including its right to receive payment from surfers) and/or its obligations under these terms of use, including the privacy statement in whole or in part, to any third party of its choice, without the need for prior approval or notification of the surfer and provided that the surfer’s rights are not harmed.
These terms of use and any dispute arising from or related to the use of the site and/or the content appearing on it will be governed exclusively by Israeli law and jurisdiction for any matter and issue related to it and/or arising from it is granted to the competent court in the State of Israel, in the Jerusalem district, only.
The terms of use, which as mentioned constitute a binding agreement between Kikar Hamusica and the surfer, exhaust the agreements between the parties and replace any representation and/or undertaking and/or agreement given previously in writing and/or orally by any of the parties. No waiver, discount, abstention or delay by Kikar Hamusica in exercising its rights under this agreement will be interpreted as a waiver or prevention unless done in writing.
The services and products offered on the site are offered to every surfer under the same conditions. Terms of use may appear on the site in translation into other languages. Translation of these terms of use appearing on the site is done in order to accurately reflect the meaning of the provisions of the terms of use, but in the event of a contradiction between the terms of use in Hebrew and their translation into another language, the Hebrew version will be the determining version.
Kikar Hamusica will be entitled to send various notices to the surfer and/or subscriber in one of the following ways:
1. Via a notice in a general information window on the site.
2. Via email to the surfer’s email address as provided by him.

Any surfer will be entitled to send notices to Kikar Hamusica via email to the address: contact@hebrewmusicmuseum.com. All notices sent to the site will be considered as received on the next business day after the date on which they were actually received. In the case of notices sent via the site, these will be considered delivered at the time of the first use of the site’s services after sending the notice.

Site Privacy Statement

This privacy statement together with the site’s terms of use together constitute an agreement between the surfer and Kikar Hamusica, and therefore – it should be read along with the terms of use carefully before using the site.

Kikar Hamusica, developer and operator of the site, attaches great importance to preserving the privacy of the site’s surfers and users and does its best to protect it.
“Personal information” means any information by which the user can reasonably be identified and/or information protected under the Privacy Protection Law.
Providing any information by a surfer on the site is not mandatory and is not a precondition for browsing and using most of the site’s services, but providing certain details will be required to receive certain services, as defined from time to time by Kikar Hamusica, in order to protect Kikar Hamusica’s rights and enable the provision of these services as well as to join Kikar Hamusica’s customer club. If you do not wish to provide these details, do not use the aforementioned service.
Information about a surfer will appear on the site only with the surfer’s consent.
The information and personal data provided by the surfer on the site will be stored in a database owned by Kikar Hamusica named “Kikar Hamusica’s customer database” (“database”).

The surfer declares that providing the information by him as well as his consent to this privacy policy also constitutes consent to storing the information in the database. The surfer declares and confirms that all information he entered and/or collected about him on the site and did not request to remove is information he provided to Kikar Hamusica voluntarily and with his consent. There is no legal obligation for the surfer to provide the information and it depends on his free will and consent. If you have already provided us with information and want us to remove it from our records or correct it, please contact us by email at contact@hebrewmusicmuseum.com, ask us to delete or correct the information, and we will examine the request in accordance with the provisions of the law.

The use of the information collected and stored in the database will be made only in accordance with this privacy policy and/or the provisions of any law, and this for the following purposes:

Sending updates about what is happening at Kikar Hamusica (direct mailing);

Statistical analysis of customer preferences and service optimization;

Efficiency and sale of tickets;

The surfer is entitled to request to be deleted from the mailing list and/or from the database subject to the provisions of any law, by clicking on the “removal” link appearing in each of the mailings. In the event of a request to be deleted as mentioned, Kikar Hamusica will be entitled, according to its discretion, to cancel the surfer’s registration for the service among Kikar Hamusica’s services, including removing him from the customer club.

The personal information will not be transferred to any entity, but it or part of it will actually be held by external suppliers of the database owner to whom access to the database is granted for the technical and ongoing management of the database and the customer club. If Kikar Hamusica wishes to share the surfer’s information with any entity, in a way that exceeds what is stated above, it will contact the surfer beforehand and give him the opportunity to remove his information from the database, unless the surfer has already given his consent to such use beforehand.
